Taking the circumstances of space utilization and space legislation into account , in this paper , the theory foundation of space right legal construction is put forward , which has two respects : on one hand , the establishing of relative land ownership theory which is based on the theory of social interests has prepared the theory foundation ; on the other hand , the general tendency of land multiform utilization and the following increase of dispute of space title in real life , the academia and the practical branches have begun the attempt of theory exploration and real legislation , as the actual reason , which call and give impetus to space right legislation
在法律性质上，空间权是独立的不动产财产权。结合我国空间开发利用及立法现状，本文给出了构建我国空间权制度的两大基础：社会化思想之下的相对土地所有权理念的确立，为空间权在法律上的确立奠定了理论基础；现实生活中，土地空间多重利用的普遍趋势，以及由此带来的空间权属纠纷的增多，理论界及实务部门关于空间权立法的理论探讨和实践尝试，是呼唤并推动空间权立法的现实动因。
